What is the procedure if a company or individual instructs Sylvester Mackett on a debt matter?
We will send out a letter before action. This will give the debtor 7 days to pay. We have a standard letter but we can adapt this to your particular needs. We can point out to the debtor that if a County Court Judgment is entered against them they will be black listed and have difficulty obtaining credit in the future.
What happens if we need to issue Court proceedings?
If there is no response to the letter before action we will contact you by telephone, fax or e-mail and take your instructions as to whether or not you want to issue proceedings. At this stage we will carry out a company search or a credit check if you wish us to do so. In normal cases we will issue proceedings in the County Court.
What is there is no response from the debtor?
We will enter Judgment and take enforcement proceedings. We will take your instructions but normally we will instruct the bailiff (County Court) or Sheriff (High Court) to go to the debtor's address and obtain levy on goods. Other enforcement procedures such as Attachment of Earnings or Charging Orders may be available.
What about insolvency?
We can draw up a Statutory Demand and Bankruptcy or Winding Up Petition if you wish. We will advise you should we believe this to be the best route.

What happens if the case is defended?
We will discuss with you at the outset whether or not it is likely that the case will be defended. If it is we will advise you of the likely procedure and cost involved and on the possibility of negotiations to settle the dispute.
