You have had an accident and been injured or had medical treatment go wrong - do you need the assistance of a solicitor?
Yes, you probably do. Come and see us, telephone, fax or e-mail us with your name, address, phone number and date of birth.
What information do we need?
We will need your full name and address, telephone number and date of birth. We need the date of the accident and details of what happened.
What about the injury?
We will need the full name and address of your GP for his report and it may be helpful to have some photographs taken of the injuries.
What if my injuries prevent me from coming to your office?
If you are local to us we can come and see you and the first interview is FREE. We will then assess whether you are entitled to legal aid, or if we can help you on a "no win- no fee" arrangement. It may be useful for you to check if you have any legal expenses insurance attached to your buildings insurance or household contents insurance.
What are the first steps?
We must cover what is called "Pre-action protocol" which is set down by the County Court Rules. We will, if appropriate, write to the third party or their insurance company and if necessary view the site of the accident. We will begin to investigate who was to blame and see if there were any witnesses.
If you do need to take the matter to Court we will advise you on the likelihood of success, accepting offers made and the general Court procedure.
What should I be doing?
It is important that you keep all documents relating to your accident in a safe place. These will include :
(1) any expenses and receipts relating to your injuries e.g. taxi fare receipts and prescription receipts or for purchasing any items of special equipment.
(2) all documents relating to your treatment e.g. hospital appointment cards. Keeping a diary of the accident's effects can be very helpful. If the claim is against your employer :
(3) your contract of employment
(4) your job description
What evidence will be required ?
We will obtain on your behalf :
(a) a medical report setting out your injuries and how they were caused and
(b) possibly an employment consultant's report detailing your future loss of earnings claim.
